Section 504
Section 504 of the Rehabilitation Act of 1973 is a civil rights statute that provides that: “no otherwise qualified individual with disabilities in the United States…shall, solely by reason of his/her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance or activity conducted by any executive agency or by the United States Postal Services.” 29 USCs/794.
With the passage of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act of 1973 began receiving more attention. A joint memorandum from the U.S. Department of Education and the Office for Civil Rights regarding the eligibility of students with attention deficit disorders reemphasized the requirements of Section 504.
